§1. General Provisions

  1. These Terms and Conditions set forth the rules for using the online store available at beeai.store (hereinafter: „Store”) and the rules for entering into contracts for the sale of digital content through the Store.
  2. The owner of the Store and the seller is:

    (hereinafter referred to as „the Seller”).
  3. Contact with the Seller is made electronically via the email address specified in paragraph 2 and through the contact form available in the Store.

§2. Definitions

  1. Customer – a natural person with full legal capacity, a legal entity, or an organizational unit without legal personality that makes a purchase in the Store.
  2. Consumer – A customer who is an individual making a purchase not directly related to his or her business or professional activities.
  3. A business owner with consumer rights – a natural person entering into a contract directly related to their business activities, where the terms of the contract indicate that it is not of a professional nature for that person.
  4. BeeAI Software / App – a computer program (a desktop application for Windows) that allows users to create stylized photos using artificial intelligence.
  5. Digital Content – data generated and provided in digital form, in particular the Software license and tokens.
  6. License – the right to use the BeeAI App for a period of 1 (one) year, including a starter package of 2,000 tokens.
  7. Tokens – billing units that allow AI to generate photos; 1 token = 1 generated photo. Tokens are valid only when the License is active.
  8. Account – the Customer's personal dashboard in the Store, where they can view, among other things, their license code, token balance, and order history.

§3. Products and Nature of the Service

  1. The items for sale in the Store are exclusively digital content (not stored on a physical medium):
    1. BeeAI License – 1-year access to the App, including 2,000 tokens,
    2. Token Packages – in 500, 1,000, and 2,000-token options.
  2. The store does not sell any physical products or equipment. Order fulfillment does not involve shipping any goods.
  3. The customer downloads the BeeAI app independently from the Store's website. A valid license and available tokens are required to activate the AI features.

§4. Technical Requirements

  1. To use the Store, you need: a device with Internet access, an up-to-date web browser, and an active email account.
  2. To use the BeeAI app, you'll need: a computer or tablet running Windows, a camera (built-in, USB, or a camera compatible with the supported list), and for printing—a printer that supports the 10×15 cm format. Generating photos using AI requires an Internet connection.

§5. Placing an Order and Entering into a Contract

  1. The customer places an order by selecting a product and clicking the purchase button („Buy Now” or equivalent), then filling out the order form and making a payment.
  2. To place an order, you must accept these Terms and Conditions and review the Privacy Policy.
  3. The contract for the delivery of digital content is concluded upon successful payment and confirmation of the order by the Seller (confirmation email).
  4. An invoice can be issued for each order. The customer provides the billing information (including the tax ID number) on the order form.

§6. Prices and Payments

  1. All prices listed in the Store are [net/gross] prices expressed in Polish zlotys (PLN).
  2. Payments are processed by the payment provider Przelewy24 (PayPro S.A.) and include, among others, BLIK and fast online transfers.
  3. The obligation to pay arises upon placing the order. Failure to pay by the due date will result in the cancellation of the order.

§7. Order Fulfillment

  1. Once the payment is processed, the Customer is automatically granted a License (license code) or their token balance is topped up—available in the dashboard My Account.
  2. The order is processed immediately, usually within a few minutes of payment confirmation. In the event of technical delays, the Seller will make every effort to fulfill the order without undue delay.

§8. Trial (trial version)

  1. After registering an Account, the Customer may receive a one-time free trial: 30 tokens and 14 days trial license.
  2. During the trial period, the ability to purchase additional tokens may be limited.
  3. The free trial is available only once; the Seller may implement safeguards to prevent abuse (including linking the trial to a device ID).

§9. Right to Cancel the Contract (Digital Content)

  1. Pursuant to the Act of May 30, 2014, on Consumer Rights, Consumers and Business Entities with Consumer Rights generally have the right to withdraw from a distance contract within 14 days without giving a reason.
  2. You do NOT have the right to withdraw With respect to contracts for the supply of digital content not supplied on a tangible medium, for which the Consumer is required to pay a price, if:
    1. The seller began providing with express and prior consent A consumer who was informed before the service began that Once the Seller has fulfilled its obligation, the buyer will lose the right to cancel the purchase from the contract, and acknowledged this, and
    2. The seller provided the consumer with confirmation of the conclusion of the contract (Article 38(13) of the Consumer Rights Act).
  3. By placing an order and checking the appropriate consent box at the time of purchase, the Consumer:
    1. demands that the service (provision of digital content—license code/tokens) begin before the expiration of the withdrawal period,
    2. acknowledges that once digital content is made available will lose the right to cancel from the contract.
  4. If the Consumer does not give the consent referred to in paragraph 3, the service may not begin until the 14-day withdrawal period has expired.

§10. Complaints (Digital Content)

  1. The seller is obligated to deliver digital content that complies with the contract.
  2. The customer may file a complaint by email at the address specified in §1(2), providing: the order details, a description of the nonconformity, and the desired resolution.
  3. The seller will process the complaint within the specified time frame 14 days upon receipt and informs the Customer of how the matter will be handled.
  4. If the digital content does not conform to the contract, the consumer is entitled to the rights set forth in Chapter 5b of the Consumer Rights Act (bringing the product into conformity, and in certain cases, a price reduction or rescission of the contract).

§11. Account and Terms of Use

  1. Creating an account is optional, but it may be required to process an order, access your license key and token balance, and start a trial.
  2. The customer agrees to provide accurate information and not to disclose their login credentials to third parties.
  3. It is prohibited to provide illegal content or to use the Store in a manner that violates the law or the rights of third parties.

§12. Software License

  1. The purchase of a license entitles you to use the BeeAI Application for its intended purpose for a period of 1 year from the date of activation.
  2. This license is non-exclusive and non-transferable. You may not copy, decompile, resell, or make the Software available to third parties except as permitted by law.
  3. Tokens do not expire, but they can only be used while the license is active.

§13. Out-of-Court Methods for Handling Complaints

  1. Consumers have the option of using out-of-court methods to resolve complaints and pursue claims, including through provincial offices of the Trade Inspection Authority and county (municipal) consumer ombudsmen.
  2. At the following address https://ec.europa.eu/consumers/odr An ODR platform is available for the out-of-court resolution of consumer disputes.

§14. Personal Information

  1. The Seller is the controller of Customers' personal data.
  2. The rules for processing personal data are set forth in Privacy Policy available in the Store.

§15. Final Provisions

  1. In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
  2. The Seller may amend these Terms and Conditions for valid reasons (changes in regulations, scope of services, or payment methods). For orders placed before such an amendment, the Terms and Conditions in effect at the time the order was placed shall apply.
  3. The Terms and Conditions are available free of charge in the Store in a format that allows them to be downloaded, saved, and printed.
